1 - Scope and Object of the General Conditions of the Store

These General Conditions are intended, with the order form, and the other elements referred to therein, to regulate the terms and conditions by which the Service Loja Online Silmadeiras, LDA will be governed. headquartered in Venda Nova, 8300-054 Silves, under corporate identification number 503318167 with share capital of €200,000, hereinafter referred to as Silmadeiras.

The Service consists of providing, through the address https://silmadeiras.pt access to the Online Store which, in addition to providing information on a set of products and services, allows the user, electronically, to order the products disclosed therein, under the terms and conditions described herein.

2 - Product Information and Contents

Silmadeiras will do everything possible to send all the products ordered, but it is possible that, in certain cases and due to causes that are difficult for Silmadeiras to control, such as human errors or incidences in the computer systems, it is not possible to make available some of the products requested by the user. If any product is not available after placing the order, you will be notified by email or telephone. At that moment, you will be presented with the possibility of canceling the order with the respective refund, if you have already made the respective payment.

All information about price, products, specifications, promotional actions and services may be changed by Silmadeiras.

Online Store prices may differ from Physical Store prices.

3 - Responsibilities

All products and services sold in the Silmadeiras Online Store are in accordance with Portuguese law.

The queries of data and information carried out within the scope of this Service are presumed to be carried out by the user, Silmadeiras declines any responsibility arising from the abusive or fraudulent use of the information obtained.

The user undertakes to:

  • i) Provide personal data and correct addresses;
  • ii) Do not use false identities;
  • iii) Respect imposed order limits.

If any of the data is incorrect or insufficient, and for that reason there is a delay or impossibility in processing the order, or eventual non-delivery, the responsibility lies with the User, and Silmadeiras declines any responsibility. In case the consumer violates any of these obligations, Silmadeiras reserves the right to eliminate future purchases, block access to the store, cancel the supply of any other services made available simultaneously by Silmadeiras to the same User; and also not allow the User to access any or all services provided by Silmadeiras in the future.

4 - Order Cancellations, Returns and Refunds

4.1 - Cancellation of orders

The user can cancel an online order placed at https://silmadeiras.pt, by email or in person at any time until delivery, with the right to a refund of the total amount paid. 14 February, the user has 14 days from the order date to cancel or return his purchase, without having to invoke any reason or be charged any costs, in addition to those established in paragraph 3 of article 12 and article 13.

The communication of the free termination of the contract must be made by the user to Silmadeiras through the e-mail: geral@silmadeiras.pt, or by registered letter with Free resolution form indicating the number da e order, budget or invoice, as well as the reference and designation of the material to be returned.

4.2 - Returns and Refunds

It is allowed to return any material that has not been cut , or the packaging has been opened/damaged, Once it is visible that the material has been cut or damaged, or the packaging has been opened, you may not be eligible for a full return/refund.

The customer/ User is responsible for the return and preservation of the material as well as costs associated with it. .

Refunds are made via bank transfer to the IBAN indicated by the customer after analyzing the conditions of the material, the material must be in resalable condition or packaged as sold, open packages may be accepted. deemed defective, and may affect the refund amount. The customer can choose to leave the refund on credit for future purchases.

For the purpose of cancellation, the User must indicate the following data to Silmadeiras:

  • a) Order number
  • b) VAT number with which you placed the order and delivery address

Silmadeiras reserves the right not to process orders when it verifies any inconsistency in the personal data presented or observes misconduct on the part of the buyer. Silmadeiras reserves the right not to process any order or reimbursement, in the event that there are errors in the values ​​and/or characteristics of the products, when these result from technical problems or errors unrelated to Silmadeiras.

5 - Warranty

The warranty only applies to finished products installed by Silmadeiras LDA, such as:

- Door blocks, floating floors, vinyl, solid or composite, wardrobes and kitchens, among others.

Silmadeiras guarantees the mechanical functionality of the products described above for a period of 2 years, which does not cover any external damage caused by the user or any other external condition such as humidity, fire, among others.

If the equipment breaks down, and if it is covered by the guarantee, the User may take it, together with proof of purchase and/or guarantee, to a technical assistance center of the brand.

6 - Applicable law

Applies by Portuguese law.

7 - Deliveries and Delivery Times

Silmadeiras only makes deliveries in the Algarve area, the value of the transport cost is always presented prior to the payment of any delivery.

Any other area outside the description must be requested by email or by phone.

The delivery time for products in stock is on average 3 to 5 working days, in case it is necessary to change the materials such as cuts, horse necks or other transformations, you should consult the store/warehouse for information on deadlines.

The customer must check the material on unloading and make sure that the material is in accordance with the invoice, Silmadeiras LDA is not responsible for material shortages that have not been checked on delivery.

The customer must, whenever possible, help/facilitate the unloading, helping the driver when necessary, if this is not possible, he must inform Silmadeiras LDA prior to delivery, through the available means so that a helper is designated for unloading.

The material is unloaded as close to the transport vehicle as possible, in the case of buildings, the customer must indicate in advance which floor it is, as transport to the destination may not be feasible.

Silmadeiras LDA reserves the right, whenever it deems necessary, to refuse to deliver material outside the limits that it considers acceptable.

8 - Alternative Dispute Resolution

In the event of a dispute, you may appeal to one of the following Consumer Dispute Resolution Entities:
